Terms of Service

1. Acceptance

By signing up for PracticeIQ, you agree to these Terms of Service. These terms form a legally binding agreement between your clinic and PracticeIQ.

2. The Service

PracticeIQ provides:

  • AI-powered patient communication via SMS, WhatsApp, and voice
  • Automated campaigns (HEP adherence, reactivation, no-show recovery, insurance reminders)
  • A dashboard for monitoring patient engagement
  • Integration with Cliniko practice management software

3. Eligibility

PracticeIQ is available to:

  • Registered Allied Health businesses in Australia
  • Clinics with a valid Cliniko subscription
  • Practitioners who have the authority to communicate with patients on behalf of their clinic

4. Clinic responsibilities

You agree to:

  • Use PracticeIQ only for lawful patient communications
  • Ensure you have appropriate patient consent for automated messaging
  • Comply with the Australian Spam Act 2003 and Privacy Act 1988
  • Keep your Cliniko API key confidential
  • Not use PracticeIQ to send unsolicited messages to people who are not your patients
  • Not attempt to reverse-engineer or exploit the service

5. Pricing and billing

  • Plans are billed monthly or annually as selected
  • 14-day free trial available — no credit card required to start a trial
  • Billing begins at the end of the trial period if you choose to continue
  • All prices are in Australian dollars (AUD) and include GST
  • You may cancel at any time from your dashboard
  • No refunds for partial months — cancellation takes effect at the end of the current billing period

6. Fair use

PracticeIQ is designed for genuine patient communication by registered health practices. We reserve the right to suspend accounts that:

  • Send bulk unsolicited messages
  • Exceed reasonable usage for a practice of their size
  • Use the service for purposes other than patient communication

7. Intellectual property

  • PracticeIQ's software, branding, and content are owned by PracticeIQ
  • Your clinic retains ownership of your patient data
  • You grant PracticeIQ permission to access your Cliniko data solely to provide the service

8. Limitation of liability

PracticeIQ is a communication tool. We are not liable for:

  • Clinical outcomes resulting from patient communication
  • Patient decisions made based on messages sent
  • Missed appointments where automated messages were sent correctly
  • Loss of revenue if messages are not delivered due to patient opt-outs or carrier issues
  • Our total liability is limited to the fees paid in the previous 3 months

9. Service availability

  • We aim for 99.5% uptime but do not guarantee it
  • Planned maintenance will be notified in advance
  • We are not liable for Twilio, Cliniko, or other third-party service outages

10. Termination

We may suspend or terminate accounts that:

  • Violate these terms
  • Have outstanding payments after 14 days
  • Are used fraudulently

You may terminate at any time from your dashboard. Upon termination, your data is deleted within 30 days.

11. Governing law

These terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in NSW courts.
